Definitions of Real Estate Brokerage Relationships

Buyer's Agent+

A buyer's agent works solely on behalf of the buyer and owes duties to the buyer which include the utmost good faith, loyalty and fidelity. The agent will negotiate on behalf of and act as an advocate for the buyer. The buyer is legally responsible for the actions of the agent when that agent is acting within the scope of the agency. The agent must disclose to potential sellers all adverse material facts concerning the buyer's financial ability to perform the terms of the transaction and whether the buyer intends to occupy the property. A separate written buyer listing agreement is required which sets forth the duties and obligations of the parties.

Seller's Agent+

A Seller's agent works solely on behalf of the seller and owes duties to the seller which include the utmost good faith, loyalty and fidelity. The agent will negotiate on behalf of and act as an advocate for the seller. The seller is legally responsible for the actions of the agent when that agent is acting within the scope of the agency. The agent must disclose to potential buyers or tenants all adverse material facts about the property actually known by the broker. A separate written listing agreement is required which sets forth the duties and obligations of the parties.


A transaction-broker assists the buyer or seller or both throughout a real estate transaction with communication, advice, negotiation, contracting and closing without being an agent or advocate for any of the parties. The parties to a transaction are not legally responsible for the actions of a transaction-broker and a transaction-broker does not owe the parties the duties of an agent. However, a transaction-broker does owe the parties a number of statutory obligations and responsibilities, including using reasonable skill and care in the performance of any oral or written agreement. A transaction-broker must also make the same disclosures as agents about adverse material facts concerning a property or a buyer's financial ability to perform the terms of a transaction and whether the buyer intends to occupy the property. No written agreement is required.

Pre-Qualified vs. Pre-Approved

The current mortgage market is extremely competitive. Lenders must have an informal "measuring stick" in order to offer their clients a product. In order to establish your bargaining power with home sellers, our buyers get Pre-Qualified for a mortgage loan in advance. Thus a Pre-qualification is the informal measuring stick. Pre-approval is the lender's commitment that they can offer the mortgage, subject to a specific property. Pre-approval is subject to a lender check (checking income, assets, credit responsibilities, etc).

Pre Qualification+

Pre-Qualifying for a loan entails sitting down with a lender and discussing what you can afford given your down payment (if necessary), debts, and future mortgage considerations.

This meeting allows the buyer and the lender to decide which loan product is best for the buyer.  It also includes a discussion of what a comfortable payment is versus what a client really qualifies for. 

Pre Approval+

Pre-Approval is granted by your lender only upon approval and verification of your credentials, your income, debt load, credit report, and more. Some Lenders find the information from your previous tax returns sufficient. Other requests range from proof of employment, to the need for a co-signer. The sheer number of options involved in borrowing the money for your new home do not allow for all facets to be covered here. Talk to your Agent for more detailed options for you.

No Down Payment+

With the help of the US Department of Agriculture guaranteed loan more people are able to qualify for a home loan. Sometimes steady income and good credit is not enough to qualify of a home loan. If you can't seem to save money for the down payment and closing costs you may be forced into paying rent when you really want a home of your own. Through the RHS Loan Program, moderate income people can qualify for a mortgage without a down payment! Current market rates for this loan are 7.50% fixed 30 year term. There is no limit on seller contribution and loans may include closing costs, pre-paids and guarantee fee. Who's Eligible You must have an adequate and dependable income and a citizen or legally admitted for permanent residence. Your credit history must show the willingness to meet obligations and any collections and/or judgments must be paid before a loan is submitted to our underwriters.

What Homes Qualify+

New or existing stick built or modular homes qualify, new manufactured homes also qualify as long as they are purchased from an RED' approved dealer and there are double wide on a permanent foundation. (Ask us for a listing of dealers) Existing homes must be structurally sound, in good condition and meet USDA thermal standards. A home inspection and a termite inspection are required to ensure the dwelling is safe and termite free. Small acreage is allowed but must generally be 5 acres or less. Each county has a maximum income limit, loan limit and must be in a rural area Check with us on the limits and areas.

My credit line is not the best. What Can I do?
A credit score is a number lenders use to help them answer the question: "If I give this person a loan, will I get paid back in full and on time?" Scores distill the information that exists in your credit bureau report to provide a "snapshot" of your credit risk picture at a given time. Because your credit report changes when new information is added, your score will change over time to reflect any updated information. Your score is based on numerous factors. Delinquencies are an important factor in bank lending decisions. Someone who always pays their bills on time creates a reliable track record that the bank can be comfortable with. On the other hand, banks are more reluctant to lend to someone who consistently pays late. Similarly, the amount of debt you have will help a bank determine if they should issue you a loan.
